NORTH CAROLINA MOBILE NOTARY SERVICE AND TRAVEL FEE AGREEMENT

North Carolina General Statute §10B-31(5), along with the NC Administrative Rules under 18 N.C. Admin. Code 07K .0205, state that any notary public charging fees to travel will need to obtain written consent in advance. Along with this, the following information will need to be recorded: the date of consent, Principal’s name (the party receiving the notary services), notary’s name, estimated mileage that will be traveled, the fee charged per mile traveled and the date that the notary services will be rendered.

Note: Please provide your full legal name as it appears on your valid ID. The name provided in this agreement and the signature applied to the notarial act must exactly match the legal name as it appears on your identification.

GENERAL INFORMATION

DATE OF CONSENT: Will be the date that you, as the principal and/or the service preparer for the mobile notary services check that you've read and agreed to the terms within this agreement.
PLANNED TRAVEL DATE: Date that will be noted and agreed to between AUTS and you (the principal and/or party ordering the mobile notary services).

NAME OF PRINCIPAL (SIGNER) and WITNESS(ES): Please provide full legal name as shown on valid ID.

FEE SCHEDULE

NOTARIAL ACT (Paper): $10.00 per principal signature needed
OATH OR AFFIRMATIONS: $10.00 per person (No Signature Required)
TRAVEL FEE (Per the IRS): $0.76/mile
ESTIMATED MILEAGE (Round Trip): Will be determined and confirmed between the principal and AUTS, once the location has been agreed upon.
TOTAL ESTIMATED TRAVEL FEE: Will be calculated once the mileage has been confirmed, and the notary services have been agreed upon between the principal and AUTS.

TERMS & POLICIES

1. ID Requirement:
The Principal will have to provide a valid government-issued photo ID. For any reason, if the notarization cannot be legally completed because the ID is missing or invalid, the booking deposit (Travel Fee) will be retained for covering the Notary’s time and travel.

2. Non-Refundable Booking Deposit:
The Travel Fee that is listed above is considered as a non-refundable booking deposit. The Notary earns this deposit at the time of booking and reserving the appointment in order to cover the cost of transit.

CANCELLATION, REFUND, AND NON-COMPLETION POLICY

1. Non-Refundable Travel Fee:
The Travel Fee, aka the booking deposit (based on the current IRS mileage rate), is considered earned once the Notary begins transit to the agreed-upon location. If the appointment is canceled by the Principal while, the Notary is in transit, or if the Notary arrives and the service cannot be completed, the Travel Fee is non-refundable.

2. Inability to Complete Notarial Act:
If the Notary arrives at the appointment but is legally unable to perform the notarization due to circumstances including, but not limited to:

  • The Principal (signer) fails to provide a valid, government-issued photo ID.

  • The Principal is not physically present or is unable to communicate coherently.

  • The Principal appears to be under duress or lacks the mental capacity to understand the document.

  • The document contains blanks or is otherwise incomplete under NC law.

In such cases, any pre-paid Notarial Act Fees ($10.00 per signature) will be refunded to the Principal within 3-5 business days; depending on the processing time from the financial institutions that are being used. However, the Travel Fee will be retained to cover the Notary's time and expenses.

3. Rescheduling:

Appointments rescheduled with at least 2 hours’ notice may have the pre-paid Travel Fee applied to the new appointment time at the Notary's discretion. The note that depending on the distance, or the time of day of transit due to traffic can affect the time that the Notary will need to leave in order to make it to the agreed location at least 10-15 minutes to the appointment.

4. Notary Rescheduling and Delays:

Due to an unforeseen circumstance (traffic, an emergency, an illness, etc.), if the Notary is unable to attend the appointment at the scheduled time, the Notary will provide notice to the Principal as soon as possible. The Principal shall have the option to:

  • Reschedule the appointment at no additional travel cost, or

  • Receive a full refund of any pre-paid travel fees and notarial fees.

SIGNATURE AND DATE

With the Principal’s signature and date, both Parties hereby agree to the terms and conditions set forth in this Agreement. With scheduling and ordering the mobile notary services online, both Parties will understand that by the Principal and/or Service Preparer reading and clicking on agreeing to these terms, this will be held has their electronic signature; the Principal and/or Service Preparer, agree to pay the traveling fee as noted above. I understand that this fee will be considered a booking deposit, and is in an addition to the actual notary services that will be charged.
